Sometimes it will not be possible to get a sick leave, even if the signs of disability are obvious. The list of such cases includes:

  • injury (illness) in the implementation of illegal actions;
  • suspension of the employee from the duties performed;
  • registration of sick leave after recovery;
  • violation of the hospital regime by the patient;
  • the employee works under a contract.

In all other cases, you have the right to count on payments in connection with temporary disability due to illness. When a sick leave is received during vacation, the number of days spent on treatment is added to the vacation, or, as agreed with the employer, is postponed to another date.

Calculation features

The calculation of the sick leave in 2018 is carried out according to a certain algorithm. It involves a number of sequential stages:

  1. determination of the total income received over 2 years;
  2. calculating the average income for 1 day;
  3. keeping track of the number of days on sick leave;
  4. application of the seniority ratio.

When calculating the sick leave in 2018, the total two-year income of the employee is taken "dirty", that is, excluding tax deductions and contributions to social funds. To determine the average income for 1 calendar day, the total amount of income is divided by 730, or 731 (depending on whether there was a leap year in reporting period). Dates of being on sick leave are always written on the sheet, so calculating the number of working days will not be a problem. If a citizen works according to the schedule, then the number of work shifts is taken into account.

The seniority ratio should be discussed separately. The general principle of accrual of funds during illness can be formulated as follows: the longer the length of service, the higher the payments. In 2018, the following rules will apply:

  • work experience over 8 years - 100% of payments;
  • 5-8 years - 80% of salary payments;
  • 6 months-5 years - 60% of salary;
  • less than 6 months -% is set based on the minimum wage.

It turns out that it is financially unprofitable to go on sick leave when you have worked for an employer for less than 6 months. Nevertheless, one should not neglect the deteriorated state of health and try to work in case of illness only for the sake of maintaining a salary.

An example of calculating sick leave 2018

Let's say you have to go on sick leave in 2018. Then, to make calculations, it is necessary to take into account the wages received in 2017 and 2016. If for 2017 the income "dirty" is 600,000 rubles, and for 2016 - 580,000 rubles, then summing up the values, we get: 600,000 + 580,000 \u003d 1,180,000 rubles. Next, we divide the resulting number by the number of days (in our case it is 730) and we get 1616, 44 rubles.

The indicator of the average earnings for 1 day is multiplied by the number of working days spent on sick leave (weekends and holidays are also taken into account). Suppose that their number is 8, and therefore the total number of payments for the time of disability will be 12,913.75 rubles. Do not forget to multiply the amount received by the seniority ratio. If it is equal to 6 years, then the calculation will look like this: 12,913.75 x 0.8 \u003d 10,331 rubles. Personal income tax will be deducted from these finances, which are charged to the salary. According to the law, the maximum amount of sick leave payments will not exceed 270,450 rubles.

Thus, the calculation of sick leave in 2018 will be governed by the same standards. By simple mathematical operations, you can determine the exact amount of payments and compare it with the value written on the payroll sheet.

Temporary disability can occur for various reasons: illness, injury, quarantine, the need to care for a sick family member. Depending on this, the period for which the sick leave is issued and during which the employee is absent from the workplace is different.

Of course, not all employees are ready to go to the clinic and issue a sick leave, preferring to negotiate with their superiors and not go to work to get medical treatment. But such situations are not provided for by law. Therefore, we will not argue for how long a person may not appear at the workplace and how often one can ask for leave from work. It all depends on various circumstances.

But if an employee is seriously ill and decided to go to the clinic to get sick leave, then only the attending physician will be able to determine how long it takes a person to recover. Most often these are short periods - from several days to several weeks. But sometimes it takes longer to be treated. To find out the maximum period of sick leave in 2019, personnel officers should familiarize themselves with which issuance rules have been introduced.

This document says:

  • on sick leave due to injury, poisoning or a complex illness, a citizen can be on treatment for no more than 10 months, and in some cases, the sick leave period can be extended to 12 months;
  • if the reason for feeling unwell is pregnancy and forthcoming childbirth, there is no need to wait for the employee earlier than 140 days. In some cases, sick leave due to pregnancy and childbirth is extended for up to 156 or 194 days;
  • women who decide to adopt someone else's child are granted sick leave for up to 70 calendar days, and if two or more babies are adopted - up to 110 days;
  • a parent who has received a sick leave to care for a child may ask for a certificate of temporary disability for the entire period of the patient's stay on treatment;
  • until complete recovery, sick leave is also provided for quarantine and prosthetics.

However, most often the sick leave is opened for a period of up to 15 days. An increase in the term is possible only by agreement with the commission of doctors. Moreover, both state and private clinics (provided that such commercial clinics have a license to carry out medical activities) work according to the same rules, therefore, without good reason, an employee will not be able to stop working for a long time.

Separately, we note that the employee does not always have the opportunity to promptly inform about the reasons for his absence and the opening of the sick leave. Therefore, it is better for personnel officers not to immediately put down alphabetic or numeric codes of failure to appear in the time sheet for disrespectful reasons. Of course have art. 81 of the Labor Code of the Russian Federation, from which it follows that absence from the workplace for more than 4 hours in a row can be considered as absenteeism. But situations are different, so in order to exclude corrections, you can put "НН" ("30") with a pencil, and when the employee explains the reasons for his absence, indicate the correct code - absenteeism ("PR", "24") or temporary disability ("B ", "nineteen").

A few more words about the sick employee. It is forbidden by law to fire him, even if the sick leave is long and he is absent from work for a very long time. In the case of women who are on sick leave in connection with pregnancy and childbirth, even criminal liability is provided for unjustified dismissal (Article 145 of the Criminal Code of the Russian Federation). The only situation when the employer has the opportunity to terminate the employment contract with the sick employee is the liquidation of the organization (termination of the IP). All other cases are losing. Because in case of coercion to dismissal or dismissal on the initiative of the management, a person can complain to the court or labor inspection.

Is the entire term of the sick leave paid

Despite the fact that officials are actively promoting the issuance of sick leaves in electronic format, many organizations still continue to work only with paper sick leave certificates. Now let's talk about whether the length of the sick leave affects the amount paid to employees. If we are talking about illness or injury of the citizen himself, then he will be compensated for the lost earnings for the entire period of absence. Exceptions are persons with disabilities. For them, a limitation of clause 3 of Art. 6: pay either 4 months of absence from work due to poor health, or 5 months a year.

If a sick leave is issued in connection with caring for a sick child, it is important to take into account certain rules when calculating payments. In particular, from April 10, 2018, the following procedure was introduced: the possible period of sick leave is limited only by the period of treatment prescribed by the doctor, but the payment of benefits is carried out within:

  • 120 days during the year if a parent is caring for a sick disabled person under 18 years of age. It is permissible that parents or other relatives who have the right to take care of a child draw up sick leaves one by one, and each of them received benefits during the period specified by law;
  • 60 days a year, if sick leave and benefits are due in connection with caring for a preschooler (up to 7 years old), and if the child's illness is complex, then no more than 90 days a year will be paid;
  • 45 days during the year if a parent is caring for a sick family member between the ages of 7 and 15;
  • the entire period of absence will be paid if the sick leave is open for caring for a child with HIV or cancer.

If, for some reason, the employer makes a mistake and counts the sick leave more than the prescribed amount, no fine or other punishment will follow. However, by law, companies are obliged to pay their employees benefits only for the first three days of illness, and for the remainder of the illness, the Social Insurance Fund, which receives monthly contributions from employers, compensates for the costs. In the event of an overpayment, the difference will be borne by the company that incorrectly calculated the amount of the benefit. The FSS will refuse to compensate (return) it, and this must be taken into account when calculating sick leave benefits.

What else determines the maximum sick leave in 2019

Figured out how long they pay. But the maximum amount of sick leave in 2019, according to the law, is also limited and depends not only on the number of sick days, but also on other factors, namely on the length of service of the employee and the maximum base for calculating social insurance premiums in specific periods.

So, the maximum sick leave payment in 2019 is calculated based on the limit values \u200b\u200bof 2016 and 2017. - 718,000 and 755,000 rubles, respectively. The maximum daily earnings taking into account these indicators will be: (718,000 + 755,000) / 730 \u003d 2017.80 rubles, where 730 is the number of days in the two previous years.

2017.80 rubles is the maximum amount per day of illness that an employee with more than 8 years of experience can count on.

For an employee with work experience of 5 to 8 years, the upper limit of the allowance is less - 2017.80 × 80% \u003d 1614.24 rublesfor one day , since this category of workers is entitled to only 80% of their earnings.

If the employee, according to the work book, has worked less than 5 years, then the allowanceon sick leave he is entitled to 60% of his daily wages. In this case, the most that he can get for a day of illness is 1210.68 rubles (2017.80 × 60%).

Concerning minimum amount benefits, it is determined by the minimum wage at the time of illness. This indicator is used in cases where the employee has a short work experience or the calculated amount of the benefit for one day is small. In particular, from 01.05.2018 at the federal level, the minimum wage was set at 11,163 rubles. Please note, in accordance with clause 11.1 of the Decree of the Government of the Russian Federation of June 15, 2007 No. 375, it is necessary to use the federal indicator when calculating sick leave. The only exceptions are calculations in the regions for which regional coefficients to wages... In these areas, the allowance must be calculated taking into account these coefficients.

The amount of sick leave benefits, based on the minimum wage in the amount of 11,163 rubles, for one day is:

(11 163 × 24 months) / 730 days \u003d 367 rubles.

As you understand, the final amount will depend on the length of service of a particular employee, calculated from the entries in the work book, and the duration of the illness (in calendar days).

What to do if the allowance is higher when calculating

In some cases, workers have a higher average daily income, so it turns out that their sick leave benefit should be higher. The employer, of course, can pay it, but it will not be possible to reimburse the money from the FSS. The fund will be able to return only that part that does not exceed the limit.

If your organization is registered in the region where the pilot project "Direct payments from the Social Insurance Fund" is being carried out, you will not need to calculate the benefit at all. Based on the data on the average salary, length of service, and the hospital itself, the Foundation will calculate everything on its own.
