But the minimum wage is understood as the amount approved by a separate normative act that is not related to the minimum wage accepted for calculating payments to employees of organizations. Federal Law No. 82-FZ of June 19, 2000 designated the minimum wage for the purpose of paying fines, penalties and taxes in the amount of only 100 rubles. This amount is still accepted for the above purposes, for example, if it is written that the amount of penalties is 5 minimum wages, this means that the company must transfer 500 rubles to the budget.

Refusal to apply the new minimum wage in Moscow

If you do not take any action after the indicator of the new minimum wage has been announced, it will be considered that the employer recognizes the provisions of the tripartite agreement and undertakes to focus on the current minimum wage when calculating salaries for its employees.

If it is decided to try to obtain permission to establish wages below the minimum wage, you first need to substantiate the reasons for disagreement with the value of the new minimum wage. Weighty arguments will be recognized:

  • significant impact of the economic crisis in the country on the company's activities;
  • insufficient number of orders from the company's clients to get the opportunity to increase salaries for employees;
  • the risk of increasing the level of salaries to the need to lay off a large number of employees.

It is necessary to formalize the employer's refusal to follow the new minimum wage in writing and send it to the Committee on Labor and Employment within a month from the date of publication of the text of the agreement on the recalculation of the minimum wage in the regions.

An employee's monthly salary must not be below the fed level. The minimum wage, if:

The minimum wage is established simultaneously throughout the territory of the Russian Federation. At the same time, in the constituent entities of the Russian Federation, the minimum wage can be established. Federal minimum wage from 01.07.2017

Recall that the federal minimum wage from 01.07.2017 increased by 300 rubles and amounted to 7,800 rubles (Federal Law of December 19, 2016 No. 460-FZ). Prior to that, the last time the "minimum wage" increased a year ago: from 01.07.2016 it was in the amount of 7,500 rubles per month (Federal Law of 02.06.2016 No. 164-FZ).

Minimum wage 2017 by region

A regional minimum wage can be established in a subject of the Russian Federation on the basis of an agreement of this subject. At the same time, of course, the regional "minimum wage" cannot be less than the federal minimum wage (Article 133.1 of the Labor Code of the Russian Federation). If a subject of the Russian Federation has its own minimum wage, it should be applied to all employees of this subject. An exception was made only for organizations financed from the federal budget, or those employers who refused to join the regional minimum wage, following the necessary procedure for this.

Please note that since July 1, 2017, following the growth of the federal "minimum wage" in some cases, the minimum wage in the regions has changed. The latest data can be found in the respective regional agreements.
