Entrepreneur Vazhenina Inna Vladimirovna (Vologda region, Cherepovets) (hereinafter - Vazhenina I.V.) applied to the Arbitration Court of the Vologda region with a claim against the limited liability company "Liana" (OGRN 1043500280416 Vologda region, Cherepovets) ( hereinafter - LLC "Liana") on the recovery of 98,921 rubles. 73 kopecks, including: 53,413 rubles. 57 kopecks - debt for the delivered products, 45,508 rubles. 16 kopecks. - penalties for violation of the terms of payment for goods at the rate of 0.3% of the value of unpaid goods for each day of delay in payment as of 11/26/2013.

In support of the claimed claim, the plaintiff referred to the fact that the defendant had not fulfilled its obligations to pay for the products received and the article of the Civil Code of the Russian Federation.

The plaintiff has been duly notified of the acceptance of the statement of claim for the court proceedings and its consideration in the manner of simplified proceedings.

The ruling of the court on the acceptance of the statement of claim for the proceedings of the court and its consideration in a simplified procedure, sent to the address of the state registration of the defendant, was returned to the court due to the expiration of the storage period, as evidenced by the mark on the mail notification.

The defendant did not use his right to submit a response to the claim or objections to the consideration of the case by way of summary procedure.

The case was considered in accordance with the rules of Chapter 29 “Consideration of Cases in the Order of Simplified Proceedings” of the Arbitration Procedure Code of the Russian Federation.

Having examined the materials of the case, the court considers that the claims are subject to satisfaction on the following grounds.

The plaintiff entered into a food supply contract with the defendant on 17.12.2011 (ld 17).

On 18 consignment notes for the period from 23.01.2013 to 01.02.2013, the defendant received various food products from the plaintiff.

In accordance with clause 4.2 of the contract, the defendant undertook to pay for the products received within 14 days from the date of receipt.

According to the article of the Civil Code of the Russian Federation, obligations must be fulfilled properly in accordance with the terms of the obligation and the requirements of the law, other legal acts, and in the absence of such conditions and requirements, in accordance with the customs of business or other usually presented requirements.

The defendant did not fulfill his contractual payment obligations and paid for the products received in part. In addition, the defendant made a return of products in the amount of 1 809 rubles. 54 kopecks. according to the invoice dated 02/20/2013.

Thus, according to the evidence presented and the plaintiff's calculation, the defendant's debt for unpaid products at the time of consideration of the dispute was RUB 53,413. 57 kopecks

Based on clause 6.2 of the agreement for late payment money defendant lawfully accrued interest in the amount of 45 508 RUB. 16 kopecks. at a rate of 0.3% of the value of unpaid goods for each day of delay in payment for the period from 16.02.2013 to 26.11.2013.

The calculation of the penalty interest by the plaintiff is correct and is not disputed by the defendant. No petitions from the defendant to reduce the penalty charged by the plaintiff on the basis of an article of the Civil Code of the Russian Federation have been made. Consequently, the court on its own initiative is not entitled to reduce the penalty charged by the plaintiff on the basis of 333 of the Civil Code of the Russian Federation.

According to part 3.1 of the Article of the Arbitration Procedure Code of the Russian Federation, the circumstances referred to by the party in support of its claims or objections are considered recognized by the other party, unless they are directly challenged by it or disagreement with such circumstances does not follow from other evidence substantiating the objections presented regarding the essence of the stated requirements.

In such circumstances, the plaintiff's claims to recover the principal debt and penalties shall be satisfied.

The plaintiff, when filing a claim with the court, paid the state duty in full. Upon satisfaction of the claim, the state duty shall be attributed to the defendant.

Alexey is responsible for creativity, development and strategy, Inna ties the castles in the air to the earthly foundation.

Alexei: - Do I call Inna to the carpet? No, I myself come to her on the carpet. How do we manage together? Naturally, over the years of joint work, some rules have been established. For example, we try not to cancel each other's decisions. If one of us announced something in front of subordinates or partners, so be it. In private, when no one hears, we can, of course, reproach - they say, are you sure that it was right? By the way, at home we try not to talk about work. After five or six o'clock in the evening this topic

Inna:- Some questions need to be left in the office in order to solve them constructively, without emotions. It is imperative to separate two areas, personal and business.

Alexei: - We came to this recently, just a couple of years ago. Unfortunately, it is not always possible to talk about home at home, problems that have not been resolved in the workplace creep into the house after us. The business is rather big, and I can only learn some information at home from Inna Vladimirovna.

Meeting at the bridge

Aleksey of Cherepov and Inna, a native of Baku, met in Vologda - they studied in parallel groups at the local Polytechnic University at the engineering department. In the near future, Alexey saw himself as a foreman at a metallurgical plant (his father worked as a shop manager for many years), Inna dreamed of a career as a mathematician at a research institute.

Inna: - Our meeting took place on the bridge ...

Alexei: - I approached the acquaintance very seriously ... Inna was one of the most interesting and bright girls of the university, besides, she came from a wealthy family, and I lived in a hostel on a scholarship. Inna: - And by that time I already knew this young man, but only visually: we sometimes attended general lectures. However, Alexey has already managed to interest me. He was the only one of all the students who drew pencil drawings in a lecture book. Everyone else drew with a pen, and he with a pencil. I really liked it. Such a tiny detail, but how much it says - about accuracy and dignity. In other words, when he approached the bridge, I was in a favorable mood.

Alexei: - Besides, your friends have already whispered to you that a certain comrade is interested in you ... In short, the next day after our first conversation, she herself came up to me in the student cafeteria ...

Inna:- There were terrible queues, and I, seeing a familiar person at the very distribution, took advantage of the situation: "Lesha, hello, can I come to you?" They sat down, of course, side by side. And they never parted. After walking for a year or a little more, Inna and Alexey got married as fourth-year students.

“The times were hard,” Alexei recalls. - There was no gasoline, no flowers, no vodka, no restaurants ...
- Rings on coupons, and white shirts too, - Inna adds.

In the fifth year, exactly when it was necessary to defend a diploma, the Vazhenins had their first son. Young mom and dad took care of diapers and solving the issue of maintaining a family that was growing before our eyes. There was no time for leisurely pencil drawing of future destinies and careers, so I had to improvise. So business came to the Vazhenin family.

Chasing Richard Gere

“I remember how my head was blown off at school after watching the film Pretty Woman,” recalls Aleksey Vazhenin. - I said to myself: I want to live like the hero of Richard Gere. It's not about the luxury that surrounds him, but about the feeling of independence and self-sufficiency that comes from this person.

At a time when Richard Gere on the screen washed down strawberries with French champagne, the Vazhenin spouses saved diapers, which were a rarity in the early 90s. The first-born was dressed up in diapers from a pack donated by friends only on special occasions - for going to the clinic or visiting. Most people remember their dreams, including cherished ones, only when they see a shooting star or find themselves at the table between two namesakes.

But not the Vajenins. “We wanted a lot, but we were constantly doing something in order to achieve this,” says Alexey. Inna, having a baby in her arms, worked as an accountant. Her husband did not have to be bored either: he served in the army, then helped his father-in-law sell apples (drove, unloaded, sat at the counter), worked at a factory.

The first pages of the history of the Vazhenin family business smell like apples and mint. Of the numerous human reflexes, the stake was placed on the main and innate - ruminant.

“I learned that there are wholesale markets in Moscow where you can buy chewing gum cheaply,” recalls Alexey. “I sold two bags of gum that I brought from there pretty quickly. A week later I brought two and a half bags. Further more. So we have been moving since then, without changing direction, but increasing volumes. We sell food products. Including chewing gum.

For several years, Alexei Vazhenin combined travel and trade with work at the plant. Deliberately moved from foremen to repairmen in the dirtiest workshop of the plant in pursuit of a convenient schedule.

Alexei:- And even when the profit from the business doubled or three times my salary, I could not decide to leave the factory. Until at one point my wife, who met me from shifts with black circles under my eyes and washed my overalls, insisted: let's try to go on an independent voyage.

Inna: - Doing good and really two things at the same time is impossible, you will not succeed in either. I had to choose, and the choice was obvious.

Family budget, marital responsibilities

Inna, from the first days of her husband's entrepreneurial spirit, kept accounts. The important ones assure: financial conflicts between them never arose. Including in their personal family budget. Alexei admits that finances in their family, as in most Russian families, are concentrated in women's hands, but the situation of “a ruble for lunch and five kopecks for a ticket” has passed him.

Alexei:- Even in those times when we were not rich, I was always sure that Inna would spend as much as it is right to spend at the moment. Both in everyday life and in business. And he will buy what is most needed now. And he never asked her to report on spending. Thanks to this, the money we earned was always enough for us.

Inna:- To be honest, I do not like risk, I trust more calculations, figures and analysis. Risky operations are not my strong point or my style. It is important for me that everything is laid out on the shelves. Better to earn less, but more reliable.

The principle of strict delineation of responsibilities also works in the Vazhenins' family life. Inna is in charge of the kitchen, keeps the house clean. Alexei knows where the toolbox is and what color the hammer's handle is. All home mechanisms and a garage are under his supervision.

- To be honest, in the kitchen I can make tea and cook scrambled eggs. And that's all, - he admits. - The other day, circumstances forced us to light our new stove - it did not work out the first time. But I can say with full responsibility that all the screws in the house are tightened, all the handles are working, all the windows are opening. I consider it my duty to clean and warm up not only my car in the morning, but also my wife's car. And in the evening, coming home from work, I rightfully expect Inna to bring me dinner and sit side by side.

Children and home

“I felt that I began to make good money when I stopped paying attention to food price tags,” says Alexey Vazhenin. - I understood: everything, the family is fed. And I felt freedom and joy because the first, and possibly the main goal was achieved.

The Vazhenins' second goal was to build their own house. The acquired three-storey townhouse became a bit cramped over time. A year and a half ago, a tiny princess appeared in the family, giving her parents a lot of positive emotions, but depriving her father of his home office, which was turned into a nursery. The sons grew up and got their own room. The youngest is studying at the AMTEK Lyceum, and the senior is studying business administration in London, but he spends his holidays in Cherepovets and plans to work in Russia. “I came to New Year, slept off a day and went with our driver to the shops and warehouses to get acquainted with the case, - the parents say with pride in their voice. - Our children have always worked in our company. In summer, on vacation, in free time ... In the warehouse and in the office, hands and head. We swept up, laid out the goods in the shops. "

When asked what is more useful for becoming a businessman: running around with a full bag of gum or sitting at a desk at the London International Business School, Alexei Vazhenin answers after much thought.

“Our business is to teach children to the best of their ability, and what they will do, we do not know,” he says. - But these are our children, and we will support any of their undertakings. The main thing for them and for us, as parents, is that they find their place in life, where they would be useful and where they would feel good.

Now the Vazhenins are designing a large house, and they are not afraid of the fact that their sons will soon start to live on their own, and the princess will eventually have a prince.

- Inna read somewhere a wonderful idea that it is very important for a person, even when he has matured, to have his own room in his parents' house, - says the father of the family. - It gives confidence, calmness and awareness: no matter what happens in life, he has a corner on the planet where he is loved and expected.

culinary preferences?

- On our table are the most ordinary food products, including semi-finished products. There are exotic dishes, but not often. We try to stick to a healthy diet. In the morning, be sure to have a hearty breakfast: porridge, fried eggs, meat.

- Where was the New Year celebrated?

- At home with family. At one time we tried to celebrate abroad and at a party, we did not like it.

- Are there programs on TV that you watch together?

- News broadcasts, morning and evening. There is no time to sit in front of the TV, but once a week you get to watch a good movie together on DVD.
