Sick pay on public holidays

How is sick leave paid on public holidays? In practice, it happens that during the period of temporary disability of an employee there are public holidays, which are non-working holidays. In general, no payment is made for employee vacation time. Only working days are paid. Is sick leave paid on holidays, or are they excluded from the period of incapacity for work. Let's say right away that the sick leave issued to the employee must be paid for all sick days. This is the requirement of the current legislation (part 3 of article 84.1 of the Labor Code of the Russian Federation, part 2 of article 5 of the Federal Law of December 29, 2006 No. 255-FZ). Sick pay on weekends and public holidays is not an exception.

Recall that the countdown of the period of illness begins from the first day of the disease (injury) until the employee recovers or becomes disabled (Part 1, Article 6 of the Federal Law of December 29, 2006 No. 255-FZ). Employees who have received an industrial injury or occupational disease are also entitled to hospital benefits from the first day until complete recovery or disability (clause 1, article 15 of the Federal Law of July 24, 1998 No. 125-FZ, part 1 of article 6 of the Federal Law of December 29. 2006 No. 255-FZ). It follows from this that if an employee took sick leave on holidays, all days are payable.

Thus, the payment of sick leave on holidays is the responsibility of the employer, despite the fact that public holidays, in general, are not paid to the staff.

So, sick leave payments on holidays and weekends do not apply to excluded periods. For clarity, we list the time periods for which the hospital allowance is not paid (Article 9 of the Federal Law of December 29, 2006 No. 255-FZ):

As can be seen from the table, payment for sick leave in 2018 on holidays should be made in the general manner.

If the illness of an employee of the enterprise coincided with public holidays, then the sick leave benefit must be paid for all calendar days on a sick leave. Payment for sick leave during holidays is the responsibility of the employer (clause 18 of the Regulations, approved by Decree of the Government of the Russian Federation of June 15, 2007 No. 375).

It is clear that for the days worked in the month of illness, the employee is entitled to a regular salary. That is, according to the results of the month, he will receive a hospital allowance for the days of disability and wages for the days when he performed his labor function.
