What types of restrictions are provided for by the current legislation:

A certificate of the absence of an arrest on property is issued by Rosreestr. To obtain it, you will need to pay a state fee.

All encumbrances established on real estate and subject to registration with the Cadastral Chamber are necessarily entered in the repository of information on real estate objects, which is a register of rights. Based on the meaning of the seventh article of the law "On State Registration of Rights", information about encumbrances must be provided to any person (openness of information). This means that before starting to draw up a contract for the sale of an apartment, the buyer has the right to find out whether the apartment is free from other people's rights.

The certificate of encumbrance must contain:

  • description of the apartment (address, number of rooms, total area, number of floors);
  • registered rights (that is, data on who is the owner of the apartment);
  • restrictions (or encumbrances) of rights (servitude, for example, or rent);
  • information about someone's claims to the right (for example, if there is a trial on the issue of determining shares or someone claims an apartment in court);
  • information about whether the apartment is seized by the state or municipality.

Where to get a certificate of encumbrance

An extract from the state register can be obtained at the Cadastral Chamber by paying a state duty of 200 rubles and writing an application. There is an easier way to get help - on the Internet. On the Rosreestr website, fill out the form "Providing information from the USRR", pay 200 rubles if you want a paper version of the statement or 150 rubles for an electronic statement. By the way, you can pay with electronic money, for example, through a qiwi wallet. After payment, your application will be accepted by the registrars.

The result will be sent to you by mail (or you will personally pick it up at the Cadastral Chamber), if you ordered a paper version of the extract, or an electronic document with a digital signature of the registrar will be sent to you by e-mail.

Statement form and expiration date

The requirements for the form of an extract, the procedure for sending and the list of documents that are attached to the extract are established by the Office of Rosreestr. Therefore, a certificate of the absence of encumbrances, a sample of which you can find on the Rosreestr website, provided by the seller, should not differ in color and form indicated on the website.

The certificate of absence of encumbrances, the validity of which is not established by law, contains only the information contained in the apartment on the date you submitted your application.

Logically, one can come to the following conclusion: the third part of Article 13 of the Law "On State Registration of Rights" says that the registration of real estate transactions, including the registration of encumbrances, takes no more than ten working days. Therefore, in order to find out up-to-date information about the apartment, order an extract no later than ten days before signing the contract of sale.

A certificate of the absence of encumbrances, that is, an extract from the USRR, is the only document confirming the “cleanliness” of the apartment.

If, at your request, the seller provided it to you, and ten days have already passed since the date of issue, it is advisable for you to order an extract from the Cadastral Chamber yourself.

When acquiring real estate, the participants in the transaction must be aware of whether the object of the transaction is burdened with any "add-on weight". Otherwise, you can get very “burned” by buying, for example, an apartment with a dependent or with tenants living there.

“It follows from this decision that the state has accumulated enough information about citizens to eliminate unnecessary running around. However, whether such a system will work without errors and whether it will give a return on schedule is far from a fact, ”says Tatiana Ilarionova.

According to Timur Bayazitov, a council member of the Tatarstan Chamber of Advocates, the measures taken by the authorities will certainly ease the situation of ordinary citizens: they will not have to spend extra time and money on obtaining documents. In addition, government representatives included in the list of certificates, the collection of which becomes optional, the most "problematic" papers: information about the absence of a criminal record, military service by conscription, the amount of salaries and pensions.

“But at the same time, it must be taken into account that state and municipal authorities will be forced to ensure the collection of the necessary documents in the manner of interdepartmental interaction, which is debugged quite poorly. Against the backdrop of the workload of employees with the duties of compiling various reports, this will naturally lead to an increase in the time for preparing the materials necessary for citizens,” Bayazitov said.

A number of certificates, the collection of which will be canceled

On the fact of a citizen’s appeal to the internal affairs bodies of the Russian Federation about the loss of a certificate of a labor veteran (MVD)

On deprivation of the right to drive vehicles (MVD)

On administrative offenses in the field of traffic (MVD)

On the presence (absence) of a criminal record and (or) the fact of criminal prosecution or on the termination of criminal prosecution, on being on the wanted list (MVD)

On the validity (invalidity) of the passport of a citizen of the Russian Federation (MVD)

On registration at the place of residence of a citizen of the Russian Federation (MVD)

On registration at the place of residence of a citizen of the Russian Federation (MIA)

Certificate of the body providing pension provision of a citizen, containing information on the total amount of material support of a pensioner

Information on receipt, redemption or non-receipt of a state housing certificate for the acquisition of living space (Ministry of Defense)

On the amount of taxes actually paid for the current financial year to the budgets of all levels (FTS)

On the presence (absence) of arrears in the payment of taxes, fees, penalties and fines for violation of the legislation of the Russian Federation on taxes and fees (FTS)
